St Helena Government announces new clinical negligence compensation scheme

On Friday, September 22, 2023, the St Helena Government (SHG) announced the establishment of an independently operated clinical negligence compensation scheme. This initiative aims to process and manage claims related to treatment provided by Mr. Sergio Villatoro-Bran. Although there was initial consideration to include another doctor in the scheme, SHG has decided to limit its scope for now but retains the option for future expansion.

Weightmans Solicitors have been appointed by SHG to develop a cost-effective and equitable compensation scheme for both claimants and St Helena as a whole. The primary goals of this scheme are:

- Allowing individuals who have suffered injury due to negligence to receive fair compensation without the financial risk, time, and stress associated with court proceedings.
- Ensuring that people can access the scheme without needing a lawyer, though they may choose to engage legal representatives at their own expense if desired.
- Directing funds towards claimants rather than legal fees.

Since September 2023, Weightmans has engaged in extensive discussions with Hugh James Solicitors and the Public Solicitors Office regarding the development of the scheme. No other solicitor firms have shown interest in participating in these discussions.

Hugh James Solicitors and the Public Solicitors Office have significantly influenced the development of the scheme on behalf of their clients. SHG expressed gratitude for their contributions.

Balancing the needs of those who have suffered injury with broader public interests remains a significant challenge. However, SHG is confident that it can achieve this balance and continues working towards a comprehensive solution.
